Terms & Conditions

Welcome to Borough House Creative LLC. These Terms & Conditions ("Agreement") govern the use of our podcast studio booking services. By booking and using our facilities, you agree to abide by these terms. Please read them carefully.

 

1. Booking & Payment

  • All bookings must be made through our third-party platforms, either Simplybook.me or Acuity.

  • Full payment is required at the time of booking to secure your appointment.

  • Payment processing is handled by our third-party partners. Borough House Creative LLC does not store or maintain any payment information.

 

2. Cancellation & Refund Policy

  • Cancellations made less than 24 hours before the appointment: No refund will be issued.

  • Cancellations made more than 24 hours before the appointment: A credit for the full amount will be issued for future use within one (1) year from the original booking date.

  • No-show appointments: No refunds or credits will be given.

 

3. Studio Usage Rules

To ensure a smooth and professional environment, all clients must adhere to the following policies:

  • Maximum of four (4) guests allowed per session.

  • No outside recording equipment is permitted inside the studio.

  • Clients may bring a producer or director, but they may not operate any of Borough House Creative LLC’s production equipment. They are only allowed to assist the in-house team.

  • Food is not allowed in the studio.

  • Only beverages with a cap or lid are permitted.

  • Unauthorized Equipment Handling: Clients and their guests are strictly prohibited from touching, moving, or adjusting any in-studio equipment, including but not limited to cameras, lighting, microphones, furniture, or any other house equipment, unless explicitly directed by a Borough House Creative LLC staff member. If any camera angles, focus, lighting, furniture placement, or equipment settings are altered—intentionally or unintentionally—by the client, a guest, or any individual not employed by Borough House Creative LLC, the studio accepts no responsibility for the resulting quality, framing, or usability of the footage. No refunds, credits, or reshoots will be issued for any recording affected by unauthorized interference.

Failure to comply with these rules may result in immediate termination of the session without refund.

 

4. Liability & Equipment Damage

  • Clients assume full responsibility for any at-fault damage to studio equipment caused by negligence on their part or by their guests.

  • If any equipment is damaged, the client agrees to reimburse Borough House Creative LLC for repair or replacement costs.

 

5. Intellectual Property & Studio Rights

  • Clients retain full ownership of all intellectual property, recordings, and licensing rights related to their recorded content.

  • Borough House Creative LLC reserves the right to use video portions and images from any recordings or photographs taken in the studio for promotional purposes only.

  • No client content will be sold, licensed, or distributed without explicit written consent.

 

6. Privacy & Data Collection

  • Borough House Creative LLC collects emails, phone numbers, and other contact details to facilitate bookings and communicate with clients.

  • Payment processing is handled by third-party partners. Borough House Creative LLC does not store or maintain any payment information.

  • We value your privacy and comply with applicable data protection regulations.

 

7. Dispute Resolution

  • Any disputes arising from the use of our services will be resolved through binding arbitration in accordance with the laws of the State of New York.

  • Clients agree to waive their right to file a lawsuit and instead resolve disputes through arbitration.

 

8. Force Majeure

  • Borough House Creative LLC is not liable for cancellations, rescheduling, or service interruptions due to unforeseen circumstances beyond our control, including but not limited to:

    • Natural disasters (earthquakes, floods, hurricanes, etc.)

    • Power outages or technical failures

    • Pandemics or public health emergencies

    • Government restrictions, regulations, or mandates

    • Acts of terrorism or civil unrest

  • In such cases, Borough House Creative LLC reserves the right to reschedule appointments or issue credits at its discretion.

 

9. Liability Waiver

  • Borough House Creative LLC is not responsible for:

    • Personal injury or accidents occurring on our premises.

    • Lost, stolen, or damaged personal belongings.

    • Any indirect, incidental, or consequential damages arising from the use of our facilities.

  • By using our services, clients and their guests agree to release and hold harmless Borough House Creative LLC from any claims, losses, or damages.

 

10. Modifications & Updates

  • Borough House Creative LLC reserves the right to update these Terms & Conditions at any time.

  • Clients will be notified of any changes via email.

  • Continued use of our services after changes are made constitutes acceptance of the revised terms.
